The Maine medical power of attorney, or healthcare power of attorney, is a legal document that delegates the authority to make healthcare decisions from one person, called the principal, to another person, called the agent, or the attorney-in-fact. 

In other words, the principal uses the power of attorney to authorize the agent to make healthcare decisions on their behalf.

The principal can use the medical power of attorney if they are of old age or have unstable physical or mental health, and they want to authorize someone to be able to make healthcare decisions on their behalf in case they become unable to do so. The principal will indicate what medication or medical treatment they want or don’t want to be subjected to.

Title 18-C, Article 5, Part 8 of the Maine Revised Statutes, also called the Uniform Health Care Decisions Act, regulates the status of medical power of attorney in Maine. 

According to 5-805, a medical power of attorney must have at least two witnesses sign it in order for it to be legitimate and effective. You should also inform your agent and healthcare provider about issuing a medical power of attorney.

§5-804 provides that the principal can revoke part or the entire medical power of attorney as long as they have the legal capacity. They can revoke the document in writing or verbally.

#1. Access the Medical Power of Attorney Form

The state law doesn’t require notarization of the medical power of attorney. However, if you are able to do so, you should have the notary public acknowledge the document. This will confirm the authenticity of the document and prevent potential fraud.
